Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and MadeSmarter LLC ("MadeSmarter", "we", "us"), the company that makes the MuscleGains iOS app and operates musclegains.co. By creating an account or using the app, you agree to these Terms. These Terms are between you and MadeSmarter LLC only — not with Apple Inc. ("Apple").

License

MadeSmarter LLC grants you a limited, non-exclusive, non-transferable, revocable license to use MuscleGains on Apple-branded devices that you own or control, for your personal, non-commercial use, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the app except where the law expressly permits it.

What MuscleGains is — and isn't

MuscleGains is a fitness tracking tool for healthy adults. It provides AI-generated estimates (food recognition, nutrition ranges, physique trends) and AI-generated suggestions (workout plans, coaching summaries). All estimates are approximations and all suggestions are general fitness information.

Not medical advice. MuscleGains does not diagnose, treat, or prevent any condition and is not a substitute for advice from a doctor, physiotherapist, or registered dietitian. Consult a professional before starting a new diet or training program, and stop any exercise that causes pain. You use the app's suggestions at your own risk.

Eligibility

You must be at least 17 years old to use MuscleGains.

Your account

Keep your login credentials to yourself; you're responsible for activity on your account.
Log only your own data and upload only photos you have the right to use.
Pick a display name that isn't offensive or impersonating someone else — it's visible on leaderboards.

Fair play and acceptable use

Discipline points and leaderboards only mean something if they're earned. Don't fake meals or gym photos, abuse scoring, or attempt to manipulate leaderboards or group challenges. Don't upload unlawful, infringing, or abusive content, interfere with the service, or attempt to access other users' data. We may recalculate points, remove entries, or suspend accounts that break these rules.

Premium: free trial and subscriptions

Each account may start one 7-day free trial of Premium. The trial requires no payment details, ends automatically after 7 days, and never converts into a charge on its own.
Paid Premium subscriptions — $14.99/month or $119/year (prices may vary by region and are shown before purchase) — will be offered through Apple's in-app purchase system.
When offered: payment is charged to your Apple ID at confirmation of purchase; subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel anytime in iPhone Settings → your name → Subscriptions; refunds are handled by Apple under App Store policies.
If you delete your account while holding a paid subscription, cancel the subscription in your Apple ID settings as well — deleting the account does not cancel it automatically.

Your content

You own the photos and data you put into MuscleGains. You grant MadeSmarter LLC the limited license needed to store and process them to provide the app's features to you (described in the privacy policy) — nothing more.

Our intellectual property

The app, the MuscleGains name and logo, and the content we create (designs, text, software) belong to MadeSmarter LLC and are protected by law. These Terms don't give you any right to use them except as needed to use the app normally.

Availability and changes

We're a small team improving the app continuously. Features may change, and AI providers or estimates may be updated or replaced. We aim for high availability but don't guarantee uninterrupted service. We may update these Terms; if changes are material, we'll note it in the app or on this page before they take effect.

Termination

You can stop using MuscleGains at any time, and have your account and data permanently deleted by sending a request through the contact form using your account email — we confirm the request by replying to that address before deleting. We may suspend or terminate accounts that violate these Terms.

Apple-specific terms

Because MuscleGains is distributed through the App Store, the following also applies:

These Terms are between you and MadeSmarter LLC only, not Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or support for the app. Maintenance and support, to the extent required by law, are our responsibility.
If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection or similar claims.
In the event of a third-party claim that the app infringes intellectual property rights, we — not Apple — are responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You must also comply with any applicable third-party terms (for example, your wireless data agreement) when using the app.

Disclaimer and limitation of liability

To the maximum extent permitted by law, MuscleGains is provided "as is" and "as available", without warranties of any kind, and MadeSmarter LLC is not liable for indirect, incidental, or consequential damages, injuries arising from training or dietary decisions, or inaccuracies in AI-generated estimates. Where liability cannot be excluded, our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or affects consumer rights that apply where you live.

Governing law

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. MadeSmarter LLC is a Delaware limited liability company. Mandatory consumer protections of the place where you live still apply.
